Section 1031 like-kind exchanges
For the right case and right investor, a section 1031 exchange is among the last great tax benefits available under the current Internal Revenue Code. When an investment property is sold, the investor pays capital gains tax on the gain he or she realized in the sale. Typically, the longer the property is owned, the greater the gain. Under Section 1031, however, the law provides that capital gains tax is deferred on real estate that is exchanged for other investment real estate so long as the investor owns the replacement property. We work with clients' tax advisors and are experienced in all phases of simple to complex 1031 tax-deferred exchange. We can act in an advisory capacity or serve as qualified intermediary, which is necessary to satisfy IRS requirements.
